DISCIPLINE

The Muroc Joint Unified School District recognizes that to maximize the learning potential of each student the school environment must be safe, secure and peaceful. The following guidelines, in accordance with Education Code and Board Policy, are enforced district wide in a fair and consistent manner.

The Progressive Discipline Plan was developed for all schools within the Muroc Joint Unified School District and outlines the Alternative Means of Correction that school sites may use, as well as consequences that may be issued for inappropriate student behaviors. Each administrator must consider the age, intent, and prior offenses of the student in determining the appropriate consequences. Situations not specifically addressed in this plan or unusual or extreme cases will be dealt with in accordance with District Policy and the California Education Code. If action warrants, students may be given consequences of second, third, or fourth offense on the first offense.

Alternative Means of Correction (AMC) may include, but are not limited to (no particular order):

  • Parent/Teacher Conference
  • Parent Contact
  • Warning
  • Referral to School Counselor for Intervention
  • Loss of Recess
  • Ineligibility for Extra-Curricular Activities
  • Detention
  • Exclusion from School Activities/Field Trips
  • Restitution
  • Behavior Contract

  • Community Services Referral
  • Parent Supervision
  • Parent Escorts Student to/from School
  • Class Meeting
  • Involuntary Transfer
  • Restorative Justice

All minor violations included in, but not limited to the following list, are to be dealt with using AMC:

Education Code 48915(a) and (c), as outlined below, are all expellable offenses on the first offense. This chart outlines the consequences for these serious violations.

Education Code Violations:

  • 48915(c)(1) Possession, selling, or otherwise furnishing a firearm
  • 48915(c)(2) Brandishing a knife
  • 48915(c)(3) Selling a controlled substance
  • 48915(c)(4) Committing or attempting to commit sexual assault or battery
  • 48915(c)(5) Possession of an explosive

1st Intervention/ Consequence: 5 day home suspension, notify police, and mandatory recommendation for expulsion.

Education Code Violations:

  • 48915(a)(1) Causing serious physical injury to another person except in self-defense
  • 48915(a)(2) Possession of any knife, or other dangerous object of no reasonable use to the pupil
  • 48915(a)(3) Possession of any controlled substance except for the first offense of possession of not more than one ounce of marijuana
  • 48915(a)(4) Robbery or Extortion
  • 48915(a)(5) Assault or battery upon a school employee

1st Intervention/ Consequence: 5 day home suspension, notify police, and mandatory recommendation for expulsion, unless the principal finds that the suspension/expulsion is inappropriate, due to the particular circumstance.

2nd Intervention/ Consequence: 5 day home suspension, notify police and recommendation for expulsion.

Education Code 48900(a)-48900.7 offenses are outlined below. Interventions are offered and consequences are given when a student commits one of these violations.

Education Code Violation: 48900(a)(1) Caused, attempted to cause, or threatened to cause physical injury to another person

1st Intervention/ Consequence: Possible suspension (1-5) and check in with administration upon return. Possible notification of police.

2nd Intervention/ Consequence: Suspension (2-5) and check in with administration upon return. Possible notification of police.

3rd Intervention/ Consequence: Suspension (3-5) and check in with administration upon return. Notify police.

4th Intervention/ Consequence: Suspension (4-5). Recommendation for expulsion. Notify police.

Education Code Violation: 48900(b) Possession, sale, or furnishing of any knives, firearms, or other dangerous objects

1st Intervention/ Consequence: Suspension (3-5). Expulsion recommendation, unless the principal finds that the expulsion is inappropriate, due to the particular circumstances. Notify police in case of possession of firearm, or possession of a knife.

2nd Intervention/ Consequence: Suspension (5). Recommendation for expulsion. Notify police in case of possession of firearm, or possession of a knife.

Education Code Violations:

  • 48900(c) Unlawfully possessed, used, sold, or otherwise furnished, or been under the influence of any controlled substance or an intoxicant of any kind
  • 48900(d) Offering, arranging, or negotiating to sell drugs, alcohol or any intoxicant and then substituting a look-a-like substance intended to represent drugs, alcohol, or an intoxicant
  • 48900(e) Committed or attempted to commit robbery or extortion

1st Intervention/ Consequence: Suspension (3-5). Counseling and/or community service. Possible recommendation for expulsion.

2nd Intervention/ Consequence: Suspension (5). Recommendation for expulsion.

Education Code Violations:

  • 48900(f)* Caused or attempted to cause damage to school or private property (including Graffiti/Tagging)
  • 48900(g)* Stealing, or attempting to steal school or private property

1st Intervention/ Consequence: AMC and restitution. Possible Suspension.

2nd Intervention/ Consequence: AMC and restitution. Suspension (1-5).

3rd Intervention/ Consequence: Restitution and suspension (1-5).

4th Intervention/ Consequence: Suspension (5), restitution, and recommendation for expulsion.

Education Code Violation: 48900(h)* Possessed or used tobacco or nicotine products

1st Intervention/ Consequence: AMC and possible suspension (1).

2nd Intervention/ Consequence: AMC, suspension (1-3), and counseling on cessation.

3rd Intervention/ Consequence: Suspension (1-3), counseling on cessation.

4th Intervention/ Consequence: Suspension (3-5), counseling on cessation.

Education Code Violation: 48900(i)* Committed an obscene act or engaged in habitual profanity or vulgarity

1st Intervention/ Consequence: AMC and possible suspension (1-3).

2nd Intervention/ Consequence: AMC and possible suspension (1-3).

3rd Intervention/ Consequence: AMC and suspension (1-3).

4th Intervention/ Consequence: Suspension (3-5).

Note: Severe acts of obscenity may result in possible recommendation for expulsion and possible police notification at any level of intervention.

Education Code Violation: 48900(j)* Possessed, offered, arranged, or negotiated to sell any drug paraphernalia

1st Intervention/ Consequence: AMC, suspension (1-3), counseling, and possible police notification.

2nd Intervention/ Consequence: Suspension (1-5), counseling, and police notification.

3rd Intervention/ Consequence: Suspension (3-5), counseling, and police notification.

4th Intervention/ Consequence: Suspension (5), recommendation for expulsion, and police notification.

Education Code Violation: 48900(k)* Willful defiance and/or disruption of school activities and/or the learning environment:

1st Intervention/ Consequence: AMC and possible suspension.

Education Code Violation: 48900(l)* Knowingly received stolen school or private property

1st Intervention/ Consequence: AMC, possible suspension (1-3), restitution, possible police notification.

2nd Intervention/ Consequence: Suspension (1-5), restitution and notify police.

3rd Intervention/ Consequence: Suspension (1-5), restitution and notify police.

4th Intervention/ Consequence: Suspension (5), recommendation for expulsion.

Education Code Violation: 48900(m)* Possession of an imitation firearm that is substantially similar in physical properties to an existing firearm as to lead a reasonable person to conclude that the replica is a firearm

1st Intervention/ Consequence: Suspension (1-3), confiscate item, possible police notification.

2nd Intervention/ Consequence: Suspension (3-5), confiscate item, possible police notification.

3rd Intervention/ Consequence: Suspension (5), confiscate item, recommendation for expulsion, police notification.

Education Code Violation: 48900(n) Committed sexual assault or battery

1st Intervention/ Consequence: Suspension (5), recommendation for expulsion.

Education Code Violation: 48900(o) Harassed, threatened, or intimidated a pupil who is a witness in a school disciplinary proceeding for the purpose of intimidation or retaliation

1st Intervention/ Consequence: Suspension (1-3), possible police notification.

2nd Intervention/ Consequence: Suspension (3-5), notify police.

3rd Intervention/ Consequence: Suspension (5), recommendation for expulsion, notify police.

Education Code Violation: 48900(p) Unlawfully offered, arranged to sell, negotiated to sell, or sold the prescription drug Soma

1st Intervention/ Consequence: Suspension (5), recommendation for expulsion.

Education Code Violation: 48900(q) Engaged or attempted to engage in an act of hazing or initiation or pre-initiation into a student organization

1st Intervention/ Consequence: AMC, possible suspension (1-3), possible police notification.

2nd Intervention/ Consequence: Suspension (1-3), possible notification of police.

3rd Intervention/ Consequence: Suspension (1-3), possible notification of police, possible recommendation for expulsion.

4th Intervention/ Consequence: Suspension (5), notification of police, recommendation for expulsion.

Education Code Violation: 48900(r)* Engaged in an act of bullying, including, but not limited to electronic act, directed toward a pupil or school personnel

1st Intervention/ Consequence: AMC, possible suspension (1-3).

2nd Intervention/ Consequence: AMC, suspension (1-5).

3rd Intervention/ Consequence: Suspension (3-5).

4th Intervention/ Consequence: Suspension (5), possible recommendation for expulsion.

Education Code Violations:

  • 48900(t) Aiding or abetting infliction or attempted infliction of physical injury to another person
  • 48900.2 Committed sexual harassment (grades 4-12)
  • 48900.3 Caused, attempted to cause, threatened to cause, or participated in any act of, hate violence
  • 48900.4 Engaged in harassment, threats, or intimidation, directed against school district personnel or pupils (grades 4-12)

1st Intervention/ Consequence: Suspension (1-3), counseling, possible notification of police.

2nd Intervention/ Consequence: Suspension (3-5), counseling, notification of police.

3rd Intervention/ Consequence: Suspension (5), recommendation for expulsion, notification of police.

Education Code Violation: 48900.7 Making terroristic threats against students, school officials and/or property

1st Intervention/ Consequence: Suspension (5), recommendation for expulsion, notification of police.
